Waiver of Liability
I, the undersigned, hereby waive all claims against any and all persons associated with the Jiu-Jitsu Institute, LLC. (DBA Six Blades Jiu-Jitsu Yorktown)
I agree that Six Blades Jiu-Jitsu Yorktown is in no way responsible for the safekeeping of my personal belongings while I attend class. I understand that I am participating in a martial art which has body contact. I understand that this form of martial arts involves choke holds, arm locks, neck cranks, ankle locks, throws, slams, punches, kicks, elbows, knees, and such, which could potentially cause serious injury or even death. I assume full responsibility for all my actions during and connected to the above organization. I understand the risk of participating in this form of martial arts training and hereby release the Six Blades Jiu-Jitsu Yorktown of all its agents, employees, and associates of and from any and all liability, claims, demands, actions, medical bills, and causes of action whatsoever arising out of or relating to any negligent or other act of omission, and/or any loss damage or injury, including death, that may be sustained by the undersigned or any property of the undersigned in participating in this form of training.
I, the undersigned, also state that I am in good physical condition and know of no reason why I cannot train in this form of training. I understand that in case of emergency, I hereby authorize any licensed medical personnel to perform any accepted medical assistance deemed necessary, and I agree to bear the expense of any such treatment.
As additional consideration for training at Six Blades Jiu-Jitsu Yorktown, I agree that my attendance and/or performance at the academy and abroad at events and such may be photographed, filmed, and/or taped and used by Six Blades Jiu-Jitsu Yorktown for marketing purposes and on our social media. I authorize the use of my image, and I waive any compensation thereof even if I discontinue my training at Six Blades Jiu-Jitsu Yorktown. I acknowledge that I would like to receive correspondence from the academy via telephone, mail, and email. I, the undersigned, being duly aware of the risks and hazards inherent upon participating in this form of martial arts, agree to all its rules, terms, and conditions.
I acknowledge that I agree to abide by Six Blades Jiu-Jitsu Yorktown rules, understand them, and agree to honor and obey them. I understand that disobeying the rules may, at the instructor’s discretion, result in suspension or expulsion from the Six Blades Jiu-Jitsu Yorktown, and that I will not be entitled to a refund.
In signing the foregoing release, the undersigned hereby acknowledges and represents that he/she has read the foregoing release, understands it, and signs it voluntarily, and that he/she is over 18years of age and of sound mind. If under 18, the parent/legal guardian in signing this release, agrees to all its terms and conditions.
COVID-19 WAIVER OF LIABILITY AND INDEMNIFICATION
1. I agree that I am personally responsible for my safety and actions while participating in activities at the Jiu-Jitsu Institute, LLC (DBA Six Blades Jiu-JitsuYorktown).
I agree to comply with all policies and rules, including but not limited to all academy policies, guidelines, signage, and instructions. Because the JJI is accessible by other individuals, I recognize that I am at higher risk of contracting COVID-19. With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue the JJI, its owner(s), members, agents, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party at JJI, or otherwise, while participating in any activity while in, on, or around the JJI facility/grounds and/or while using any JJI facilities, tools, equipment, or materials.
2. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the JJI facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.
3. By signing below I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in using the JJI to decide whether to sign this document; no oral representations, statements, or indictments, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Wavier of Liability shall be governed by and construed in accordance with Virginia law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole. This waiver remains in effect until the State of Virginia removes all COVID-19 related mandates.
4. I have been administered a verbal COVID-19 screening questionnaire. I have answered truthfully for myself and on behalf of my family, spouse, children and wards that [I am/we are] not or have been knowingly infected with COVID-19, nor exhibiting any symptoms related to COVID-19
